Citizenship in India and the Citizenship Amendment Act 2019: A Study

भारत में नागरिकता और नागरिकता संशोधन अधिनियम 2019 एक अध्ययन

Abstract

With the development of the modern nation-state concept, citizenship also evolved. The idea of a single citizenship was outlined by the framers of the Indian Constitution in Articles 5 to 11. After India gained independence from colonial rule, the country was divided on religious lines to form two nations, India and Pakistan. Since the division was based on religion, a large number of people migrated from one place to another, which led the framers of the Constitution to incorporate citizenship-related provisions in the Constitution, considering the circumstances of that time. However, in the present era, when the entire world is increasingly taking the shape of a global state due to advancements in science and technology, it becomes necessary to revise the concept of citizenship in line with current conditions. Keeping this in mind, the Government of India amended the Citizenship Act in 2019.

Abstract in Hindi Language: आधुनिक राष्ट्र राज्य की अवधारणा के विकास के साथ ही नागरिकता का भी विकास हुआ। भारतीय संविधान निर्माताओं द्वारा एकल नागरिकता के विचार को संविधान के अनुच्छेद 5 से 11 तक वर्णित किया गया। औपनिवेशिक शासन काल से जब भारत को स्वतंत्रता मिली उस समय भारत का धार्मिक आधार पर विभाजन कर दो राष्ट्र भारत व पाकिस्तान का गठन किया गया चूंकि यह विभाजन धर्म के आधार पर किया गया था इसलिए विभाजन के समय अत्यधिक संख्या में लोगों का  एक स्थान से दूसरे स्थान पर पलायन हुआ जिसके कारण संविधान निर्माताओं द्वारा तात्कालीन परिस्थितियों के अनुसार नागरिकता संबंधी विचारों को संविधान में वर्णित किया गया परंतु वर्तमान समय जब संपूर्ण विश्व विज्ञान एवं प्रौद्योगिकी के विकास के कारण एक विश्व राज्य का रूप धारण करता जा रहा तो वर्तमान परिस्थितियों के अनुसार नागरिकता संबंधी विचारों में संशोधन आवश्यक हो जाता है। इसी को ध्यान में रखकर भारत सरकार के द्वारा 2019 में नागरिकता अधिनियम में संशोधन किया गया।
